Scope of the policy

1.1 This policy shall apply to all Katimavik Web properties.

Purpose of the Katimavik Web site

2.1 The purpose of the Katimavik Web site is to provide information on volunteer service for youth in Canada. The Web site serves as a resource that contains general information, public relations, current news and links to other organization’s Web sites.

Web site content policies and guidelines

3.1 Katimavik recognizes the value and potential of creating files of electronic information on the Internet. All users are encouraged to publish and submit information consistent with the mission, interest, standards and policies of Katimavik. Information placed on the Katimavik Web site plays an important role in developing and maintaining the strong reputation and image of Katimavik. The Web site is an open public document available to anyone, anywhere in the world. Those who place information on the site must realize the responsibilities inherent in this form of electronic publishing

3.2 Content of all electronic pages must comply with local, provincial and federal laws including, but not limited to copyright, libel and indecency statutes. Photographs and personal information about an individual must not be included without appropriate written permission.

3.3 The use of Katimavik Internet resources for private business, commercial activities, fund-raising, merchandising, solicitation, or advertising shall be prohibited.

3.4 Katimavik reserves the right to remove any content from its servers at any time without prior notification to the creator of the content. The creator of the content will be notified of this action, and appeal of the removal of a content may be made to the Katimavik webmaster.

3.5 Violation of Web site policies may result in immediate revocation of Katimavik Web site personal content publishing privileges, and possible further disciplinary action against the person responsible for the violation. All Katimavik disciplinary policies and penalties apply to violations of Web site policies.4.6 Users are not permitted to publish personal pages, resumes, or links to resumes.

3.6 “Katimavik” is a trademark of Katimavik. All uses of the Katimavik Web site or Katimavik graphic identity must be linked to the official Web site images. No other use of the Katimavik Web site or Katimavik logo or trademark is allowed.

3.7 All documents, images, photographs, graphic designs such as a logo, once posted to Katimavik’s Internet server remain the property of Katimavik.

KATIMAVIK’S COPYRIGHT POLICY

Commercial use or publication of all or any item displayed is strictly prohibited without prior authorization from Katimavik. Nothing contained herein shall be construed as conferring any license by Katimavik to use any item displayed. Documents may be copied for personal use only on the condition that copyright and source indications are also copied, no modifications are made and the document is copied entirely.

However, some documents and photos have been published on this site with the permission of the relevant copyright owners (who are not Katimavik). All rights are reserved on these documents and permission to copy them must be requested from the copyright owners.

Katimavik takes no responsibility for the content of external Internet Sites. Any communication or material that you transmit to, or post on, any public area of the site including any data, questions, comments, suggestions, or the like, is, and will be treated as, non-confidential and nonproprietary information.

If there is any conflict between these Terms and Conditions and rules and/or specific terms of use appearing on this site relating to specific material then the latter shall prevail. These terms and conditions shall be governed and construed in accordance with the laws of Canada. Any disputes shall be subject to the exclusive jurisdiction of the Courts of Canada. If these Terms and Conditions are not accepted in full, the use of this site must be terminated immediately.

This privacy statement discloses the privacy practices for Katimavik.

Katimavik respects your privacy. Any personal information you provide to us — including your name, address, telephone number, and e-mail address — will not be released, sold, or rented to any entities or individuals outside of Katimavik.

Katimavik shares Web site usage and generic statistical information about visitors to our Web site and membership in general with reputable third parties for the purpose of securing operational funding. However, no direct or personal information that can be associated with any individual is provided to anyone outside Katimavik.

To unsubscribe from any newsletters and site update emails, users can follow the directions at the bottom of any email received from Katimavik regarding the Web site.

Katimavik and its information suppliers disclaim all express and implied warranties with regards to the site and all information services, and materials contained on the site, including without limitation any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Katimavik makes no warranty that (A) the site will meet your requirements or that the results that may be obtained from the site will be satisfactory; (B) The site will be uninterrupted, timely, secure, or error-free; (C) The quality of any products. Services, information, or other material purchased or obtained by you through the site will meet your expectations, and; (D) any errors in the site will be corrected.

Limitation of Liability

In no event shall Katimavik or its affiliates, governing board, officers, agents, employees, partners, suppliers, funders or volunteers be liable for any special, indirect, punitive, incidental, exemplary or consequential damages, or any damages whatsoever resulting from loss of use, business, data, or profits, litigation and the like, whether based on breach of contract, tort (including negligence), product liability or otherwise, even if advised of the possibility of such damages. With respect to goods or services purchased directly from Katimavik through the site, Katimavik’s liability, in any case, is expressly limited to replacement of defective goods, or, at Katimavik’s election, to the repayment or crediting to you of an amount equal to the purchase price of the goods. You acknowledge and agree that the limitations set forth above are fundamental elements of these Terms of Use and the site would not be provided to your absent such limitations. If any jurisdictions do not allow the foregoing limitations of liability, the foregoing limitations may not apply to you.

Termination

Katimavik may, in its sole discretion, with or without notice, suspend or terminate your use of this Site, and remove and discard any Content on the Site, for any reason, including, without limitation if you violate these Terms. Katimavik may also bar you from any future access to the Site. Katimavik will not be liable to you for any such suspension, termination or prohibition on future access.

Should you object to any subsequent modifications of the terms and conditions of these Terms, your sole recourse will be to immediately notify Katimavik of your termination of these Terms, which termination will be effective immediately. To the extent permitted by applicable law, the terms and conditions of these Terms will survive any termination of these Terms.
